A judge has dismissed the charges on a Fulton police officer accused of attempting to strangle the mother of his child.

Orlando Gates, 27, was cleared of aggravated assault charges, and his case retired by Circuit Court Judge Thomas J. Gardner III during a hearing in late January.

Gates was indicted in November for allegedly attempting to strangle his girlfriend and biological mother of his child, Toshua Lacey, in February 2015.

A full time officer with the Fulton Police Department, Gates was suspended from the department and temporarily transferred to the Fulton Street Department following his arrest.

Fulton Police Chief Reggie Johnson confirmed Gates has returned to his original position with the police department.
