Appeals court affirms Clay County conviction

JACKSON – The Mississippi Court of Appeals has affirmed the January 2013 conviction and sentence of Alphonzo Garth.

Garth was found guilty of the possession of more than 30 grams of cocaine and sentenced to 25 years in prison. He appealed, arguing the drugs were found after an illegal search.

According to testimony, West Point Police were looking for a suspect and found Garth with an open container. Garth struggled with an officer and threw a clear plastic bag containing something white. A drug dog later located cocaine inside the car.

Justices agreed Tuesday that there was probable cause and the search was legal.
