JACKSON – The Mississippi Court of Appeals affirmed the August 2013 conviction and sentence of Richard Moise in Lee County Circuit Court.
According to testimony during the two-day trial, Moise drove from Arkansas during the early morning hours of Jan. 1, 2013, to pick up his wife from a party in Verona. He was accused of beating up a man sleeping on the couch and then driving away. There were no witnesses.
The jury found Moise guilty, and he was sentenced to four years in prison and five years of probation. In his appeal, Moise argued that the jury should have been given different instructions and the court should have considered his motion for a directed verdict.
The appeals court sided with the lower court decision, affirming both the conviction and sentence.
